SMS Wireless/Text Message Policy

Effective: April 2025

By providing your mobile number, you are expressly consenting and opting in to receive text messages from American Finance L.L.C. (“American”) related to your account. American’s text messaging programs may include payment reminders, notifications regarding your account status, insurance information and other account communications. By providing your mobile number and opting in, you agree you have ownership rights or permission to use the telephone number given to American or its affiliates. The number of messages will vary by request and or account. Message and data rates may apply. Wireless carriers are not liable for delayed or undelivered messages. If your handset device does not support MMS, any MMS messages sent may be delivered as SMS messages. American is not liable for the acts or omissions of third-party service providers, including, but not limited to, delays in the transmission or delivery, or non-delivery, of messages due to circumstances out of American’s control.

State laws may limit American’s contact with you during a week or in a month. However, by opting in, you explicitly provide authorization for American to contact you by text message more frequently than your state law may otherwise allow.

You understand that the text messages American sends may be seen by anyone with access to your mobile device or back-up cloud service. Accordingly, you should take steps to safeguard your mobile device, cloud service and text messages if you want your text messages to remain private.

You agree and consent to be contacted by American, its agents, employees, attorneys, affiliates, subsequent creditors, account servicing companies, and third-party collectors through the use of email, calls and/or SMS text messages to your mobile phone number, including the use of automatic telephone dialing systems, auto-dialers, or an artificial or prerecorded voice.

Further, by providing your mobile number, you are opting in and providing express consent for American to use Artificial Intelligence (“AI”) to engage with you. Such AI may include conversational systems to engage with you via phone, text, email or other digital channels. These systems may simulate human interaction or generate responses automatically.

Opt-Out or STOP

This policy applies to the text messages sent by American to our customers. You may opt-out of receiving text messages from American at any time by simply type “STOP” in response to any text message we have sent you. You may also retract your consent by calling us at (800) 302-674-0365. Your stop request will become effective within one (1) business day.

NOTICE

Messages sent to you by text are an attempt to collect a debt and any information obtained will be used for that purpose. If you are entitled to the protections of the United States Bankruptcy Code (11 U.S.C. §§ 362; 524) regarding the subject matter of any text message, the following applies to you: THE TEXT MESSAGE COMMUNICATION IS NOT AN ATTEMPT TO COLLECT, ASSESS, OR RECOVER A CLAIM IN VIOLATION OF THE BANKRUPTCY CODE AND IS FOR INFORMATIONAL PURPOSES ONLY.
